Can a Notary notarize a document for a person with Dementia?

Depends on the person actually, are they early on in the progression of the disease?


Do they have more good days then bad so far, where they can still remember people or are they getting to the point where they are having a difficult time remembering people, places or things?


Would they be able to participate in a conversation with the notary and still show that they understand what is going on?


Unfortunately if the notary feels that individual does not understand what is going on anymore the notary has to refuse the notarization by law.


At that point in time the person needing stuff notarized will need to have a person designated by a judge to serve as their representative.


It’s always best when you notice that a loved one is starting to have difficulties to have this taken care of ahead of time. Otherwise when you need to buy, sell or refinance a house or any other type of legal document that needs to be signed by the person with dementia it may have to be postponed until you get that designation taken care of and if your on a time constraint that could be a huge issue.


Notary’s really want to help but we have to follow the rules and regulations imposed on us by the State we live in and represent and the penalties can be severe if we don’t.
